FTC Acts Less Like Chief Regulator, More Like Editor-in-chief

The Federal Trade Commission recently brought and settled a case against Nomi Technologies, an in-store retail analytics company, for including in its privacy policy an insignificant error that caused no harm to anyone. Daniel Castro and Alan McQuinn argue in The Hill that regulatory policy should be based on actual harm to consumers and regulators should be more careful not to inhibit innovation.
